Private prosecution in Alicante for crime victims
Private prosecution

Private prosecution in Alicante for crime victims

If you have been a victim of a crime, you can take part in the criminal proceedings with your own voice. As private prosecutor, we defend your interests from the very first steps: joining the proceedings, investigation measures, evidence, trial, appeals and compensation claims.

Your role in the proceedings

Being a victim of a crime does not mean being a mere witness in the proceedings. The law allows the injured party to intervene as a party, with their own voice: access the case file, request investigatory measures, propose evidence, file charges, request a sentence and claim the compensation they are entitled to.

In many proceedings, the difference lies in acting in time: requesting a report, preserving CCTV footage, requesting a message dump, submitting medical records or properly documenting the damage suffered. When that evidence is not requested or not properly quantified, the victim's position can be seriously harmed.

Our role as private prosecutor is twofold: technical and human. Technical, because we build the case with the rigour of someone who also practises defence and knows where the opposing party will attack. Human, because we support the person through proceedings that are often lengthy and require reliving what happened.

Scales of justice against a dark background
What we do for you

From the complaint to the collection of compensation.

  • 01

    Joining proceedings from the start

We join the proceedings as soon as the police report or complaint exists, to access the case file and not depend solely on the Public Prosecutor's decisions.

  • 02

    Complaints and criminal charges

Technical drafting of the statement of facts, legal classification and proposal of initial investigatory measures. A well-constructed complaint prevents premature dismissals.

  • 03

    Driving the investigation

Requesting medical and forensic reports, CCTV footage, messages, geolocation, bank records, telecom data, expert reports and witnesses.

  • 04

    Protection measures

Requesting protection orders, restraining orders, no-contact orders and other precautionary measures when there is a risk to the victim.

  • 05

    Civil liability and compensation

Quantification of damages: injuries and after-effects, moral damages, expenses, loss of earnings and property damage, with claims against those civilly liable and insurers.

  • 06

    Prosecution brief and trial

Own classification of the facts, sentencing request, evidence, cross-examination and final pleadings, with an autonomous position from the Public Prosecutor.

  • 07

    Appeals

Appeal against dismissal, acquittal and sentences or compensation amounts we consider insufficient.

  • 08

    Sentence enforcement

Monitoring the collection of civil liability, seizures, enforcement against insurers and monitoring compliance with the prohibitions imposed.

Common questions

What people almost always ask us.

When can I act as a private prosecutor?

Any person harmed by a crime can join the proceedings as a private prosecutor, from the very first steps until the classification stage. The sooner, the more room there is to influence the investigation.

Is the Public Prosecutor not enough?

The Prosecutor defends legality and the public interest, not your particular interests. They may not request certain investigatory measures, not appeal a dismissal, or quantify compensation differently from what you are entitled to.

Do I have to testify at trial?

In most cases, the victim testifies as a witness. We prepare that testimony with you and request, when appropriate, measures to avoid visual contact with the defendant or testimony by videoconference.

What about the costs?

A conviction can order the defendant to pay costs, including those of the private prosecution. Before taking on the matter, we clearly explain the budget and possible scenarios.

What is the difference between filing a report and joining as a private prosecutor?

Filing a report means bringing the facts to the attention of the authorities. Joining as a private prosecutor allows you to intervene as a party in the proceedings, access the case file, request investigatory measures, propose evidence, file charges, appeal decisions and claim compensation.
